The Citizen Participation in Government Act was introduced in the House as HB 1569 on Feb. 10, 2005 by Rep. Lindsley Smith. The bill failed passage in the House at first, but after amendment was approved 64-14. The amendment added the constitutional limitation that the immunity would not apply to a "statement or report made with knowledge that it was false or with reckless disregard of whether it was false." Approval of the bill in the Senate was unanimous.

An earlier bill, House Bill 2327, was introduced in the Arkansas House on March 2, 2001 by Rep. Jan Judy. The bill was withdrawn by the author on April 6, 2001 and recommended for study by the Joint Interim Committee on Judiciary.
