This was signed into law April 28, 2006. It provides that a defendant may file a motion to dismiss any legal action that involves his or her exercise of "the right of petition," defined narrowly to specifically exclude petition regarding judicial proceedings.

Senate Bill 1498
This bill, introduced in January 2005 by several senators and representatives, would have prohibited preemptive lawsuits by the government against individuals who request public records. Under the bill a government agency would not be able to file a civil action for declaratory judgment against a requestor of public records unless the requestor consented to the action. On occasion agencies file such actions to settle a dispute over whether specific public records are disclosable.
